Tin House Press provides a range of branding, publicity, and pre-publishing and post-publishing services, including but not limited to manuscript evaluation, branding consultation, and related preparatory services for publication. Details of these services, including scope, fees, and any specific service commitments, will be outlined in your service agreement.

By accessing our website, engaging our services, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms. If you do not agree to these Terms, you must not access or use our services.

1. Use of Our Services

You agree to use our services only for lawful purposes and in accordance with these Terms. Any use of our services that violates any applicable local, state, national, or international law or regulation is prohibited.

2. Intellectual Property Rights

Tin House Press respects intellectual property rights and expects the same of its users. You retain all rights to any original content you provide to us as part of the use of our services, including manuscripts, texts, and any other intellectual property. By using our services, you grant us a limited license to use, modify, perform, display, reproduce, and distribute such content solely for the purpose of providing the services you have requested.

3. Payment and Billing

3.1 Invoicing: We exclusively utilize invoicing for all transactions. This allows us to provide accurate billing tailored to the services rendered.

3.2 Installment Options: In addition to full payment options, we offer installment plans for certain services. Clients can opt to pay for their project in installments, subject to approval and agreement between both parties. Details regarding installment options, including payment schedules and any associated fees, will be outlined in your service agreement.

3.3 Variable Pricing: While most of our services are invoiced due to their customized nature, we also offer bundled publishing packages with fixed prices. These packages are designed to provide comprehensive solutions at a set cost.

3.4 Adjustments and Additions: Invoicing allows us to accommodate any adjustments or additions to the services provided, ensuring that you only pay for what you need.

4. Cancellation and Refunds

5. Delivery

The delivery timeline for each service varies and is outlined in the respective service agreement. Please review the service agreement carefully to understand the delivery terms specific to the service you have purchased.

General Delivery Guidelines:

  1. Service Agreements: The delivery timelines, conditions, and any applicable fees are clearly stated in the service agreement for each service. These terms are binding and will be strictly adhered to.
  2. Delivery Timelines: Depending on the service, delivery may be immediate, scheduled, or require a lead time. Some services may involve multiple delivery milestones or phases. Refer to your service agreement for specific delivery timelines.
  3. Delivery Methods: We utilize various delivery methods, such as electronic delivery (e.g., email, cloud storage), physical delivery (e.g., courier, postal service), or on-site delivery, as specified in the service agreement.
  4. Delivery Confirmation: Upon successful delivery, we will provide you with a delivery confirmation or receipt, unless otherwise stated in the service agreement.
  5. Delays and Modifications: In the unlikely event of delivery delays or modifications due to circumstances beyond our control, we will promptly notify you and work towards a mutually acceptable solution.
  6. Customer Responsibilities: Please ensure that you provide accurate and up-to-date delivery information, such as addresses or contact details, as required for the successful delivery of our services.

6. Limitation of Liability

Tin House Press will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

7. Indemnification

You agree to defend, indemnify, and hold harmless Tin House Press and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the service, or b) a breach of these Terms.

8. Modification of Terms

Tin House Press reserves the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
